Surrogate Baby at Center of Legal Tussle

Written by Steve Masler, CEO of Fertility SOURCE Companies

Oprah may be willing to dedicate an entire one hour TV show to surrogacy in India and to actually give it at least her tacit blessing, but lets be realistic, how much money has to be saved by Intended Parents to make it worth the potential complications?

A Japanese couple got divorced in the midst of a surrogacy process in India. The genetic mother rejected the child. So, you think that the father got the child? Think again. According to Indian law, the father has to legally adopt the child. But, that process takes a long time. The child's grandmother (the father's mother) has temporary custody but her travel visa expires in three months and after that the child's future is uncertain. The story may ultimately have a happy ending, but even if it does, the stress and cost for the family must be enormous. The child's father is an Orthopedic Surgeon. Was he really making a wise move pursuing the surrogacy process in India?

In fact, the rise in the number of foreigners arriving in India to search for surrogate mothers has prompted the Indian authorities to consider strict regulations to protect the rights of surrogate mothers and children born to them.

As often is the case, buyer beware, but the potential morass would be Intended Parents are facing with Indian surrogacy cases may be beyond the pale.

all this talk about how surrogates are only in it for the money makes me wonder if surrogacy is for me. i am currently in the process of becoming a surrogate want to become a surrogate but I don't want my family thinking that i am only doing it for the money, because that is not the case. How can I explain to my family that it is so much more.

Dear Anonymous,
I have been a surrogate three times, and yes, the compensation does help my family, but Oh My Gosh .... when you hand the baby to this family for the first time after working for a year together, you feel absolutely amazing. It's not about political views, education, religion, or anything else, but one woman helping another person become a parent. The circle of life goes on because of what I have done, it's the greatest gift I have ever had the honor of giving. I would do this forever if my body would let me. Be proud that you can help, you are helping those who cannot have children, you are teaching everyone around you about humanity. :-) Once your family meets the parents and sees you go through shots and pain for someone else, they'll get sucked in as well and be right there by your side.
Good Luck to you on your surrogacy journey. from WonderWomb

Granted, some people may think you are doing it for the money, however I personally know that the Surrogacy Source has strict guidelines and money CANNOT be the motivating drive/force behind one's want to become a Surrogate and complete a family. It takes someone very very special to carry a child for another family. Be strong and be proud that you are wanting to help another human feel the joy of parenthood and all though your family is important and their support through this process will be needed, know in your heart you are truly giving the most precious gift ever....a baby...
